1. general provisions

These General Terms and Conditions of Sale govern the terms and conditions under which IQONIQ srl (hereinafter referred to as “IQONIQ” or the “Seller”) will provide the user (hereinafter referred to as the “User”) with Limited Edition Prints* (hereinafter also referred to as “graphics” or “limited editions”).

These Terms and Conditions apply exclusively to the Products and Services sold by IQONIQ through its Website.

Users are required to carefully read these General Terms and Conditions of Sale and fully understand them before placing an order for any Product and/or Service available on the Website. When the User intends to place an order, they must confirm that they have read, understood, and accepted the content of these Terms and Conditions. Should the User not accept these General Terms and Conditions of Sale, they will not be able to place any purchase order. Users are encouraged to print and retain a copy of this document.

IQONIQ, represented by its legal representative Brian Nuciforo, is headquartered in Milan, Via Lesa 1, 20125, with Tax Code and VAT number 13049410965.

* The term “Limited Edition Print,” in general, and for the purposes of this contract and its execution, refers to an image transferred (using various techniques) onto an appropriate medium through an interaction performed with an inked device known as a “printing plate” or “matrix.”The preparation process involves a complex sequence of operations aimed at achieving continuity (though not always consistent) in the results. In printmaking or graphic art, an artist creates an original work when they produce a new printing device, form, or matrix, such as through engraving. From these forms or matrices, original prints or fine art prints are created through impression on paper or other suitable mediums.(Hereinafter individually referred to as the “Product” or “Work” and collectively as the “Products” or “Works”) available for online purchase on the IQONIQ website (hereinafter the “Website”).

2. Conclusion of the online sales contract

The purchase order (hereinafter referred to as the “Order”) represents the User’s intent to purchase the specified Product(s). The Order will be considered submitted upon the completion of the online purchase procedure in the dedicated section of the Website. After submitting the Order, the User will receive an email confirming receipt of the Order, which will include the Order Identification Number and the product details.

Each Order is subject to approval by IQONIQ and will be deemed accepted (and the online sales contract for the Product considered finalized) when the User receives an email confirming the shipment of the Product (hereinafter referred to as the “Shipping Confirmation”).

IQONIQ reserves the right to reject any Order at its discretion. Should IQONIQ refuse an Order, the User will be contacted by Customer Service via email to be informed of the rejection and will receive a refund—using the same payment method employed by the User—without undue delay for any payment already made.

Before concluding the contract, the User will be required to confirm that they have read and understood the general terms and conditions of sale, including the information regarding the right of withdrawal and the processing of personal data.

3. Right of Withdrawal

As specified by Article 52 of Legislative Decree 206/2005 (“Consumer Code”), the User may withdraw from the Contract within 14 days from the date of delivery of the Product. To comply with the withdrawal deadline, the User must follow these instructions before the end of the withdrawal period:

  • Product Care and Return Condition: The User must take all appropriate measures to preserve the Product and do everything possible to ensure that the Product is returned in the best possible condition, including its original undamaged packaging, accompanying documentation, and any other components. If the User complies with these measures, they will be entitled to a refund of the Product’s purchase price as outlined below.

  • Withdrawal Procedure: To withdraw from the Contract, the User must send a specific communication to IQONIQ no later than 14 days from the Product’s delivery. This communication must be sent via email to info@iqoniqart.com, including the Order Identification Number and the User’s intention to withdraw from the Contract.

Upon sending the withdrawal notice, the User must return the Product to the following address no later than 14 days from the date the withdrawal was communicated to the Seller: Via Lesa 1, Milan 20125, IQONIQ Srl

3. Right of Withdrawal

It is understood that the shipping costs for returning the Product will be borne by the User, who will also be responsible for the integrity of the Product until it is delivered to the Seller. For more information regarding the right of withdrawal, the User may contact IQONIQ Customer Service at +39 3468467120 or via email at info@iqoniqart.com.

If the User decides to return the Product and exercises their right of withdrawal within the 14-day withdrawal period, IQONIQ will refund the purchase price paid by the User within an additional 14 days, in accordance with Article 56 of Legislative Decree 206/2005. The refund will be issued using the same payment method used by the User for the online purchase, excluding any costs incurred by the User to ship the Product back to the Seller.

IQONIQ is not required to refund additional costs if the consumer expressly chooses a delivery method different from the least expensive standard delivery method offered. IQONIQ reserves the right to withhold the refund of the amount paid by the User until the Products have been received at the address specified above, or until the User provides proof of having returned the Products, whichever occurs first.

IQONIQ will not consider return/refund requests in cases where the returned Product is found to be damaged due to improper use, negligence, physical damage, aesthetic or surface alterations, tampering, or wear and tear. Similarly, requests for the return of Products that contain personal items of the User or Products with a serial number different from the one indicated on the delivery document accompanying the purchased Product will not be accepted.

4. Delivery methods

For the regulation of delivery and transfer of risk for the products, full reference is made to the provisions specified in Annex No. 1 (TRANSPORT REGULATIONS), which can also be consulted on the DHL website. Shipments cannot be delivered to P.O. boxes or postal codes.

Shipments will be delivered to the recipient’s address provided by the sender (IQONIQ) or by the recipient themselves, as specified in the following paragraph, but not necessarily directly into their hands. The company responsible for the transportation and delivery of the products (DHL) may inform the recipient of an incoming shipment or a failed delivery.

The recipient may be offered alternative delivery options, such as delivery on a different day, delivery in front of their residence, to a different address, to a DHL service point, or to a third party.

The delivery times for shipments are to be considered indicative and in no way binding.

5. Price and payments methods

The prices applicable to the Products are those indicated on the Website, except in cases of material and recognizable error. The prices shown on the Website do not include shipping costs, which will be explicitly indicated in a subsequent section of the online purchase process. Product prices are inclusive of VAT.

IQONIQ reserves the right to modify, at any time, the prices of the Products and the associated shipping costs. It is understood that any changes will not, under any circumstances, affect contracts already concluded before the modification

6. Modification of the conditions

IQONIQ reserves the right to modify these Terms and Conditions at any time, providing specific notice on the Website. The User acknowledges and agrees that any changes to these General Terms and Conditions of Sale will apply to orders placed by Users after the date the changes are communicated.

7. Iqoniq website

IQONIQ declares that it holds all intellectual property rights related to and/or concerning the Website and/or the materials and content available on the Website. These General Terms and Conditions of Sale do not grant the User any license to use the Website and/or individual content and/or materials available thereon. Any other use or reproduction of the Website or the materials or content therein is strictly prohibited.

IQONIQ makes no explicit or implicit warranties regarding the Website. IQONIQ will make efforts to ensure that the Website is available 24 hours a day without interruption, but it cannot be held responsible if, for any reason, the Website is inaccessible and/or not operational at any time or for any period.

Access to the Website may be temporarily suspended without notice in case of system failure, maintenance, repairs, or for reasons entirely beyond IQONIQ’s control or due to Force of Major events.

The protection and processing of your personal data will be carried out in accordance with our Privacy Policy, as specified in Annex No. 2 (PRIVACY POLICY), which can be consulted on the Website, as well as in accordance with the Privacy Notice regarding the processing of personal data in relation to purchases made on the Website.

9. Applicable law and competent court

These General Terms and Conditions of Sale and the Contracts governed by them are exclusively regulated by the current Italian law. For any dispute that may arise between IQONIQ and the User in relation to the General Terms and Conditions of e-commerce Sale and/or individual Contracts, the exclusive competent jurisdiction will be that of Milan.
